Terms of Service

These Terms of Service (“Terms”) govern your use of the Whiskerys online store and any purchase you make from it. The store is operated by PRESNSE, 703, Lemmi Centre, Kwun Tong, Hong Kong (“Whiskerys”, “we”, “us”). By using the store or placing an order, you agree to these Terms.

1. Eligibility

You must be at least 18 years old, or the age of majority where you live, to place an order.

2. Products and information

We try to describe and photograph our products accurately. Colours, finishes and sizes may vary slightly from images. Content on this store, including articles about pet care, is general information only. It is not veterinary advice, and our products are not intended to diagnose, treat, cure or prevent any disease. Always consult your veterinarian about your pet’s health.

3. Prices and availability

Prices are shown in the currency displayed at checkout and may change at any time before you place an order. Promotional or launch pricing may end without notice. If a product is listed at an incorrect price or with incorrect information because of an error, we may cancel any orders placed for it and refund you in full, even after your order is confirmed.

4. Orders

Your order is an offer to buy. We accept it when we dispatch your items. We may refuse or cancel any order, including for suspected fraud, stock issues or errors, and will refund any payment taken for a cancelled order.

5. Payment

Payment is taken at checkout through our payment providers. You confirm that you are authorised to use the payment method you provide.

6. Shipping

Shipping times and costs are described in our Shipping Policy. Delivery estimates are not guaranteed.

7. Returns, refunds and warranty

Returns, refunds and warranty claims are governed by our Refund Policy, which forms part of these Terms.

8. Safe use

Use our products only as described in the included instructions. In particular, do not submerge the motor module, and supervise your pet’s use of any new product. Keep water fresh and clean the fountain and replace filters regularly. We are not responsible for damage or injury caused by misuse, modification, or failure to follow the instructions.

9. Intellectual property

All content on this store, including text, images, video, logos and designs, belongs to Whiskerys or its licensors and may not be copied or reused without our written permission.

10. Reviews and submissions

If you send us a review, photo, video or other content, you give us a non-exclusive, royalty-free, worldwide licence to use, reproduce and publish it in connection with our business. You confirm that you own it and that it does not break any law or anyone else’s rights.

11. Disclaimer

Except as expressly stated in these Terms and our Refund Policy, and to the fullest extent permitted by law, the store and our products are provided “as is”, without any other warranties, express or implied, including implied warranties of merchantability or fitness for a particular purpose.

12. Limitation of liability

To the fullest extent permitted by law, Whiskerys will not be liable for any indirect, incidental, special or consequential loss or damage arising from your use of the store or our products. Our total liability for any claim relating to an order is limited to the amount you paid for that order. Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law.

13. Indemnity

You agree to indemnify Whiskerys against any claims, losses or costs arising from your breach of these Terms or your misuse of our products.

14. Governing law

These Terms are governed by the laws of the Hong Kong Special Administrative Region. The courts of Hong Kong have non-exclusive jurisdiction over any dispute. If you are a consumer, you also keep the benefit of any mandatory consumer protection laws of the place where you live.

15. Changes

We may update these Terms from time to time. The version published on the store when you place an order applies to that order.

16. Your statutory rights

Nothing in these Terms affects any rights you have under consumer protection laws that cannot be waived.
